Abstract
ABSTRAK
Hak Cipta di Indonesia memiliki kedudukan yang sangat penting dalam perlindungan Hak Kekayaan Intelektual di Indonesia dikarenakan substansi yang diatur dalam Undang-Undang Hak Cipta Nasional berkaitan langsung dengan kepentingan nasional dalam rangka terwujudnya tujuan negara dalam menjamin hak ekonomi. Realitanya Undang-Undang Hak Cipta Nasional merupakan bentuk implementasi ketentuan-ketentuan WTO/TRIPs Agreement serta instrumen-instrumen hukum internasional lainnya. Kondisi demikian mengakibatkan Hukum Hak Cipta Nasional tidak sepenuhnya mengabdi pada kepentingan nasional dan berpotensi menghambat terwujudnya tujuan negara dalam menjamin hak ekonomi. Batik dilindungi oleh Undang-Undang Hak Cipta sebagai bentuk ciptaan. Tingkat kesadaran dan pemahaman masyarakat khususnya pengusaha Industri Kecil Menengah terhadap hak cipta masih rendah. Diperlukan penerapan Undang-Undang Hak Cipta yang sesuai dan dilandasi dengan kesadaran hukum untuk mencapai kesejahteraan masyarakat.
ABSTRACT
Copyright in Indonesia has a very important position in the protection of Intellectual Property Rights in Indonesia because the substance regulated in the National Copyright Law is directly related to national interests in the context of realizing state goals. In reality, the National Copyright Law is a form of implementation of the provisions of the WTO/TRIPs Agreement and other international legal instruments. Such conditions result in the National Copyright Law not fully serving the national interest and potentially hindering the realization of state goals. Batik is protected by the Copyright Law as a form of creation. The level of awareness and understanding of the community, especially Small Industry entrepreneurs Medium to copyright is still low. It is necessary to apply the Copyright Law that is appropriate and based on legal awareness to achieve public welfare.
